As secretariat for the Healthy Newborn Partnership (“HNP”), Save the Children Federation, Inc. through its Saving Newborn Lives initiative maintains this website and the contents thereof (“electronic products, services and/or technology”) in order to provide you with information about the status of newborn care worldwide and the many resources available for enhancing understanding. This Linking and Use Agreement describes our understanding with you when you visit and use this website, the electronic products and services and/or technology. YOUR USE OF THE WEBSITE, ELECTRONIC PRODUCTS AND SERVICES, TECHNOLOGY AND/OR DOWNLOADING OF LINKS TO THE WEBSITE OR ELECTRONIC PRODUCTS AND SERVICES CONSTITUTES YOUR AGREEMENT TO THE TERMS AND CONDITIONS SET FORTH HEREIN.
We encourage you to read the entire policy as it sets forth our understanding with you when you visit our website. These terms and conditions have been developed for your protection, as well as ours. Use of the technology, electronic products and services provided at the website is solely at your own risk.
Throughout this policy, you will see the terms "Save the Children," "we," "our," and "us" - these terms refer to Save the Children Federation, Inc. a Connecticut non-stock corporation with tax-exempt status pursuant to Internal Revenue Code Section 501(c)(3). You will also see the terms “I,” "you," "your," and "yours" - these terms refer to visitors to and users of the Healthy Newborn Partnership Website.
In the United States, Save the Children is the sole owner of the name “Save the Children” which, is a registered trademark. In addition, Save the Children is the U.S. licensee of the of the International Save the Children Alliance logo.
1. LINKING TO THE HEALTHY NEWBORN PARTNERSHIP WEBSITE AND USE OF WEBSITE MATERIALS, NAMES, LOGOS, ELECTRONIC PRODUCTS AND TECHNOLOGY.
Participants in the Healthy Newborn Partnership appreciate information and educational uses of the materials and technology appearing on this website. However, there are limits on the use of these materials, including the use of the names and logos of agencies appearing on this website.
Please be aware: by copying and/or downloading content, documents or other materials from the Healthy Newborn Partnership you agree to the terms and conditions set forth in this Terms of Use and Linking Agreement and any terms and conditions outlined elsewhere on this website. Without limiting any other conditions, the use of the Healthy Newborn Partnership website, materials, electronic products and services, including but not limited to the names and logos of Healthy Newborn Partnership participating organizations is subject to:
a) Your use of names and logos of Healthy Newborn Partnership participating organizations may not indicate or create the impression that the Healthy Newborn Partnership or any participating organizations endorse, approve, sponsor or are affiliated with your goods, services or your website.
b) Your use of the names and logos and/or links bearing the names and logos of the Healthy Newborn Partnership or any Healthy Newborn Partnership participating organizations may not indicate the impression that the Healthy Newborn Partnership or participating organizations will benefit from the sale of any good or service.
c) Links bearing the name and logo of the Healthy Newborn Partnership and/or any the Healthy Newborn Partnership participating organizations may only be used for the purpose of linking to the Healthy Newborn Partnership website as designated within the link.
d) The links bearing the name and logo will always be active links.
e) Neither the Healthy Newborn Partnership name and logo and/or link bearing the Healthy Newborn Partnership name and logo nor the names/logos and/or links bearing the Healthy Newborn Partnership participating organizations’ names/logos may be combined with graphic elements; nor may they be altered in any manner including size, proportions, arrangement, colors or elements; nor may they be animated; morphed or otherwise distorted in perspective or appearance.
f) Neither the Healthy Newborn Partnership name and logo and/or link bearing the Healthy Newborn Partnership name and logo or the names/logos or links bearing the names/logos of Healthy Newborn Partnership participating organizations may appear more prominently than your personal, company, product, or service website name.
g) You will not transfer, assign, sell, reproduce, distribute or otherwise exploit the name or your link to Healthy Newborn Partnership or to any Healthy Newborn Partnership participating organization.
h) Neither the Healthy Newborn Partnership name and logo and/or link bearing the name and logo nor the names/logos or links bearing the names/logos of the Healthy Newborn Partnership participating organizations may appear in connection with any pages of any websites that include content or advertising for alcoholic beverages, pornography, religious material, partisan material, political material, firearms, or other products contrary to the intent of this website.
i) Appropriate action by Save the Children as the secretariat of the Healthy Newborn Partnership may include but is not limited to, the revocation of the right to use the Healthy Newborn Partnership name and logos and/or any links bearing the Healthy Newborn Partnership name and logo, in which case you agree to remove the name and logo and/or the links bearing the name and logo within 3 days of notice of revocation.
Please be aware: violation of someone’s copyright, trademark, or other intellectual property may subject you to civil and/or criminal penalties.
2. INAPPROPRIATE USE OF HEALTHY NEWBORN PARTNERSHIP MATERIALS, ELECTRONIC PRODUCTS AND SERVICES
It is inappropriate to use Healthy Newborn Partnership materials, including electronic products and services and/or technology for illegal, inappropriate purposes, or in support of such activities. We define these terms as follows:
“Illegal activities” are those that violate laws, regulations, and/or private agreements, in federal or state laws governing copyright laws, trademark laws, legal agreements or other intellectual property rights.
“Inappropriate uses” are any uses other than as permitted by this Terms of Use and Linking Agreement, or as may be permitted elsewhere on the website.
“Obscene activities” are those that violate generally accepted social standards for use of material or technology.
PLEASE BE AWARE: Save the Children Federation, Inc. may seek appropriate action to terminate any uses of the Healthy Newborn Partnership website and/or the electronic products, services or technology available therein in the event we, in our sole discretion determine that your use: does not conform to any of the conditions of this Terms of Use and Linking Agreement or as provided elsewhere on the Healthy Newborn Partnership website; infringes any intellectual or other rights of the Healthy Newborn Partnership participating organizations or a third party; adversely affects the reputation of the Healthy Newborn Partnership or any of the Healthy Newborn Partnership participating organizations, products, services or programs; violates any applicable law, regulation or ordinance; and/or is a prohibited activity.
Listed below are some, but not all, prohibited activities that may result in Save the Children Federation, Inc. taking action:
a) Posting, transmitting, or facilitating in the promotion of illegal content through the Healthy Newborn Partnership website or via the electronic products, services or technology available therein.
b) Using the Healthy Newborn Partnership website, electronic products and services and/or technology to harass, embarrass, or do anything else to another visitor or third party that is unwanted.
c) Transmitting or facilitating distribution of content that is untrue, threatening, harassing, racially or ethnically offensive, vulgar, sexually explicit, obscene, defamatory, or objectionable;
d) Using the name and logo or links bearing the name and logo of Healthy Newborn Partnership or Healthy Newborn Partnership participating organizations on websites found to be objectionable, or which includes obscene, violent, intolerant, tasteless, denigrating or sexually oriented content or materials.
e) Pretending to be anyone whom you are not. You may not impersonate representatives from Save the Children, other Healthy Newborn Partnership participating organizations, or anyone else.
f) Posting any unsolicited content or designs, including advertising and promotional material on the Healthy Newborn Partnership website.
3. MISCELLANEOUS
a) Save the Children Federation, Inc. reserves the right to make any change to the information and/or provided at the Healthy Newborn Partnership website at any time for any reason. You acknowledge and agree that you are responsible for keeping up with any such changes.
b) Federal and Connecticut state law shall govern this agreement.
